Terms of Service

These Terms of Service govern your use of One Seven Technologies' services. By engaging our services, you agree to be bound by these terms. Please read them carefully.

1. Services Offered

One Seven Technologies provides comprehensive technology solutions, including but not limited to:

  • Website Development
  • Web Application Development
  • Software Development
  • Mobile Application Development (iOS and Android)
  • Server Management
  • Hosting Management
  • DevOps Solutions
  • Ongoing Maintenance and Support

The specific scope of services will be defined in individual project agreements or statements of work.

2. Payment Terms

Payment Structure

Unless otherwise agreed in writing, our standard payment terms are:

  • 50% upfront payment before project commencement
  • 25% payment upon reaching 50% project completion
  • 25% final payment upon project delivery

Refund Policy

Once an agreement is signed by both parties, refunds are generally not offered. All payments made are non-refundable except in cases of gross negligence or breach of contract by One Seven Technologies.

Non-Payment

Failure to make payments as agreed may result in:

  • Suspension of work on the project
  • Withholding of project deliverables
  • Legal action to recover outstanding amounts
  • Additional fees for late payments

3. Intellectual Property Rights

Ownership Upon Completion

Upon full payment of all fees, the client will own the final deliverables, including all code, designs, and related materials created specifically for the project.

Portfolio Rights

One Seven Technologies retains the right to showcase completed projects in our portfolio, marketing materials, and website as examples of work done. However, we do not claim ownership of the final product.

Pre-existing Materials

Any pre-existing code, frameworks, libraries, or tools used in the project remain the property of their respective owners. The client receives a license to use these materials as part of the delivered product.

4. Project Scope and Changes

Scope Definition

The project scope will be clearly defined in the initial agreement or statement of work. This includes deliverables, timelines, and specific features to be developed.

Scope Changes and Iterations

Our approach to scope changes depends on the plan selected:

  • Basic Plans: Do not include iterations or scope changes. Once the deal is finalized, additional requests will not be entertained without a separate agreement and additional fees.
  • Premium Plans: Include a specified number of iterations and feature additions as outlined in the agreement.

Any scope changes beyond what is included in your plan will be subject to additional fees and timeline adjustments.

Change Requests

All change requests must be submitted in writing. We will provide a quote for additional work, including cost and timeline impact, before proceeding.

5. Warranties and Support

Support Period

Depending on the support plan you have selected, technical support is provided for a defined period after project delivery. The duration and scope of support will be specified in your agreement.

Post-Support Period

After the support period expires, One Seven Technologies is not responsible for any issues, bugs, or functionality problems in the delivered application. Continued support can be arranged through a separate maintenance agreement.

No Insurance Coverage

One Seven Technologies does not currently carry professional liability insurance. Our liability is limited as described in Section 6 below.

6. Limitation of Liability

To the maximum extent permitted by law:

  • One Seven Technologies shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services.
  • Our total liability for any claims related to our services shall not exceed the total amount paid by the client for the specific project in question.
  • We do not guarantee that our services will be error-free or uninterrupted.
  • The client is responsible for maintaining backups of their data and content.

7. Termination

Termination by Client

If the client terminates the agreement after work has commenced, regardless of the reason:

  • The client must pay 20% of the total project cost as a cancellation fee
  • Any work completed up to the termination date will be delivered to the client
  • All payments made prior to termination are non-refundable

Termination by One Seven Technologies

We reserve the right to terminate an agreement under exceptional circumstances, such as:

  • Client's failure to provide necessary materials or information
  • Client's breach of these terms
  • Unethical or illegal requests

If we terminate the agreement, no additional payments will be required from either party. Any payments already made will be handled on a case-by-case basis depending on the work completed.

8. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project. This obligation continues even after project completion or termination.

We will not disclose client information to third parties without explicit permission, except as required by law.

9. Client Responsibilities

The client agrees to:

  • Provide timely feedback and approvals
  • Supply all necessary content, materials, and access required for the project
  • Ensure all provided content does not infringe on third-party rights
  • Make payments according to the agreed schedule
  • Communicate clearly and professionally

Delays caused by the client may result in project timeline extensions and potential additional costs.

10. Governing Law and Dispute Resolution

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India.

Jurisdiction

Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

Dispute Resolution

Before pursuing legal action, both parties agree to attempt to resolve disputes through good faith negotiation. If negotiation fails, either party may pursue legal remedies.

11. Modifications to Terms

One Seven Technologies reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified terms.
